Terms of Service

1. Platform Role

TRUKR operates as a digital marketplace connecting Shippers with Carriers, and Equipment Owners with Renters. TRUKR is not a carrier, freight forwarder, or equipment owner. We provide the technology platform to facilitate these transactions.

2. KYC & Vehicle Compliance

Every commercial vehicle must maintain a valid NTSA Commercial Road Service License (RSL), an annual Certificate of Roadworthiness, and a functional KS 2295 speed governor. Commercial drivers must hold a valid Class C/CE driving license and a clean DCI Certificate of Good Conduct. Cross-border trips require an active COMESA Yellow Card.

3. Milestone Escrow & Payment Settlement

• Tripartite Escrow: Shippers deposit 100% of the agreed freight fee into a regulated escrow trust account prior to dispatch.
• Loading Advance: Upon verified cargo loading and departure, 30% of the freight fee is released to the carrier for fuel, tolls, and per diems.
• Final Settlement: The remaining 70% balance is released immediately upon delivery confirmation via Cryptographic e-POD and OTP verification.

4. Shipper Axle Load Warranty (EACVLCA 2016)

Shippers expressly warrant that cargo weight complies with the 56 metric tonne Gross Vehicle Weight limit under the East African Community Vehicle Load Control Act, 2016. Shippers agree to indemnify TRUKR and Carriers against all weighbridge fines resulting from misdeclared weights.

5. Equipment Rental (RIGR) & 40-Point Inspection

• Inspections: All heavy machinery must hold a valid 40-point safety inspection certificate before deployment.
• Site Conditions: Hirers warrant site ground bearing capacity, utility line clearances, and safe operational conditions.

6. Limitation of Liability

To the maximum extent permitted by Kenyan law, TRUKR's aggregate financial liability arising out of any transaction shall in no event exceed the facilitation commission retained for that specific order.
